Rivers State Gov Tribunal Resumes Monday

The governorship election will resume its sitting today Monday, July 6, 2015 in Abuja.

The main agenda for today’s hearing centers on pending applications that have been filed before the tribunal.

The current governor of the state, Chief Nyeso , is battling to save himself from being removed from his position at the tribunal.

The All Progressives Congress () and its governorship candidate in the state, Dr. Dakuku Adol Peterside, filed a petition against Wike noting that elections in the state was not credible.

Here is an update of proceedings so far:

Immediate past Chairman of INEC, Professor Attahiru Jega, and the commission’s Resident Electoral Commissioner (REC) in the state, Dame Gesila Khan, have continued to maintain their stand that the 2015 general elections in the state was free and fair.

Already, there is tension in the state over the resumption of the tribunal, following reports in the social media that there were attempts to bribe members of the tribunal so that their judgment would be in favour of one of the parties involved.

Wike, along with the governors of Akwa Ibom and States, Udom Emmanuel and Dairus Ishaku, respectively, had protested the relocation of the election tribunals of their respective states to Abuja, the Federal Capital Territory.

Wike’s lead counsel, Ukala had during the June 23, 2015 sitting of the tribunal argued that the ex-parte order made was unknown to law and that it breached the provisions of the Electoral Act, 2010, as amended, adding that the order was made despite a motion challenging the jurisdiction of the Tribunal pending before the court.

The tribunal chairman, Pindiga, adjourned the case until today, Monday, July 6, to enable parties file their replies on point of law and for the hearing of all the pending applications.

On June 11, 2015, the tribunal ordered that the APC and its agents be allowed access into INEC office along Aba Road, Port Harcourt, to inspect materials used for the governorship election.

The order of the tribunal reads in part, “That leave is hereby granted the petitioners/applicants to bring and argue this application outside or before the pre-hearing session.

But, the APC on June 19, 2015, accused some top officials of INEC in the state of deliberately denying its agents access to some election materials as ordered by the Election Petitions Tribunal.
